Privacy Policy

SmartSail, Inc. (“SmartSail,” “Pathr,” “we,” “us,” or “our”) operates the Pathr marine navigation application and related services (the “App”). This Privacy Policy explains what personal information we collect, how we use and share it, and the rights you have — including rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”).

1. Personal Information We Collect
We collect the following categories of personal information. The bracketed label is the corresponding CCPA statutory category.
- Account and identity information (Identifiers; Customer records) — your email address, display name, profile photo, and a user ID. Authentication is handled by our provider, Clerk; we do not store your login password.
- Precise geolocation (Geolocation data; Sensitive Personal Information) — your device's GPS location, including continuous location collected in the background while you are actively recording a sail, so your trip is not lost when your screen is locked. Precise geolocation is treated as Sensitive Personal Information under the CPRA.
- Vessel and trip information (Commercial information) — vessel details you enter (name, dimensions, draft, performance specs), planned routes, waypoints, saved places, trip history, and sailing logs.
- User-generated content (Visual/other content) — marina and hazard reports, problem reports, notes, and any photos you choose to attach (from your camera or photo library).
- Social features (Identifiers; Geolocation data) — if you use friends or location-sharing features, we process your connections and, when you opt in, share your real-time location with the friends you select.
- Device, usage, and technical information (Internet/network activity; Identifiers) — app version, device type and OS, IP address, push-notification token, diagnostic logs, and how you interact with the App.
We do not intentionally collect special categories of data beyond the precise geolocation described above, and we do not collect audio recordings.
2. How We Collect It
- Directly from you — when you create an account, configure a vessel, plan a route, submit a report, or contact support.
- Automatically from your device — location (with your permission), device and usage data, and diagnostics.
- From service providers — authentication data from Clerk, and map, weather, point-of-interest, and maritime data from the third parties listed in Section 5.
3. How We Use Your Information
We use personal information to:
- provide and operate the App's navigation, charting, weather, routing, trip logging, and social features;
- create and secure your account and keep you signed in;
- generate and display routes, waypoints, and situational-awareness information;
- send trip reminders and other notifications you enable;
- respond to reports, feedback, and support requests;
- maintain safety, prevent fraud and abuse, debug, and improve the App; and
- comply with legal obligations and enforce our Terms.
We use your precise geolocation (Sensitive Personal Information) only to provide the navigation, trip-logging, and location-sharing features you request, to secure those features, and as otherwise permitted by CPRA § 7027(m). We do not use or disclose Sensitive Personal Information to infer characteristics about you.
4. Legal Bases (where applicable)
Where required, we rely on: performance of our contract with you (providing the App), your consent (e.g., location permission, location sharing), our legitimate interests (security, improvement), and compliance with law.
5. How We Share Information
We share personal information only as described here. We use service providers (“processors”/“service providers” under CCPA) that are contractually limited to processing data on our behalf:
- Clerk — authentication and account management.
- SmartSail backend (hosted on Amazon Web Services) — storage and processing of your account, vessel, route, and report data.
- Google Places — point-of-interest lookups (search terms and approximate location may be sent to Google).
- Weather data provider (e.g., Meteoblue) — to display weather overlays (map viewport coordinates may be sent).
- NOAA, OpenStreetMap, Wikipedia/Wikimedia, and AIS data sources — to display charts, base maps, place details, and vessel-traffic information (requests may include map coordinates and your IP address).
- Mailchimp — email list management and newsletter sign-ups on our marketing website (email address and related contact information may be sent to Mailchimp when you sign up).
- Other users — content you choose to share (e.g., reports) and, only if you opt in, your real-time location with friends you select.
- Legal and safety — to comply with law, respond to lawful requests, or protect the rights, safety, and property of users and the public.
- Business transfers — in connection with a merger, acquisition, or sale of assets, subject to this Policy.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined under the CCPA/CPRA. We do not use third-party advertising SDKs.
6. Data Retention
We keep personal information for as long as your account is active and as needed to provide the App, then for any additional period required to comply with legal obligations, resolve disputes, and enforce agreements. Trip and route history is retained until you delete it or close your account. When you delete your account, we delete or de-identify your personal information within a commercially reasonable period, except where retention is legally required.
7. Your Privacy Rights
California residents (CCPA/CPRA)
You have the right to:
- Know / Access the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of recipients.
- Delete personal information we hold about you, subject to legal exceptions.
- Correct inaccurate personal information.
- Opt out of sale or sharing — we do not sell or share personal information, so no action is needed, but you may still submit a request.
- Limit the use of Sensitive Personal Information — we already limit use of precise geolocation to the purposes in Section 3.
- Non-discrimination — we will not discriminate against you for exercising your rights.
How to exercise your rights: email team@smartsail.ai, or, where available, use the in-app Settings → Delete Account control. We will verify your request using your account email. You may use an authorized agent; we may require proof of authorization. If we deny a request, you may appeal by replying to our response. We aim to respond within 45 days.
Shine the Light (California Civil Code § 1798.83): we do not disclose personal information to third parties for their own direct marketing.
Other rights
Depending on where you live, you may have additional rights (e.g., to portability or to object). Contact us and we will honor rights that apply to you.
8. Location Permissions and Controls
The App requests location permission to show your position, provide navigation and weather, and log trips. Background (“Always”) location is used only to keep recording an active sail when the app is backgrounded or the screen is locked. You can change or revoke location and notification permissions at any time in your device settings; some features will not work without them.
9. Children's Privacy
The App is not directed to children under 16, and we do not knowingly collect personal information from children under 16. If you believe a child has provided us personal information, contact us and we will delete it.
10. Security
We use administrative and technical safeguards, including secure storage of session tokens on your device and encrypted transport (HTTPS). No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. International Users
We are based in the United States and process and store information in the U.S. If you use the App from outside the U.S., you understand your information will be transferred to and processed in the U.S.
12. Changes to This Policy
We may update this Policy from time to time. We will post the new version with a revised “Last updated” date and, for material changes, provide additional notice in the App.
